Supreme Court rules Railways liable to pay open access surcharges
The Supreme Court of India has dismissed Indian Railways’ appeal and upheld the Appellate Tribunal for Electricity (APTEL) ruling that the national transporter is not a deemed distribution licensee under the Electricity Act, 2003. The Court held that Indian Railways remains liable to pay Cross-Subsidy Surcharge (CSS) and Additional Surcharge while procuring power through open access, as the electricity is used for self-consumption rather than supply to consumers. The judgment, delivered on May 8, 2026, is expected to have significant financial implications for distribution companies across multiple states.
SC bars discoms from recovering depreciation on idle assets
The Supreme Court of India has set aside an Appellate Tribunal for Electricity (APTEL) order and ruled that Tata Power Delhi Distribution Limited (TPDDL) cannot recover depreciation costs for the decommissioned 108 MW Rithala gas-based plant after it stopped supplying electricity in March 2018. The Court restored the 2019 Delhi Electricity Regulatory Commission (DERC) order and held that consumers cannot be made to pay for services no longer received. The ruling clarifies that technical useful life and regulatory tariff recovery period are distinct concepts under electricity tariff regulations.
