Waaree clarifies CBP findings on U.S. solar imports

Waaree Energies Limited has issued a clarification regarding recent media reports on a determination by the U.S. Customs and Border Protection (CBP) in EAPA Consolidated Investigation No. 8163. The company said the determination followed a detailed investigation, including an on-site verification of its manufacturing facility in India.

According to Waaree, CBP confirmed that the company did not export to the United States solar modules manufactured using Chinese-origin solar cells. The company also stated that CBP acknowledged its full cooperation throughout the investigation, drew no adverse inference against it and declined the petitioner’s request to make an evasion finding covering all of Waaree’s imports.

Waaree said the determination is limited to a narrow subset of certain historical import entries and does not constitute a final adjudication. Under U.S. law, the company has the right to seek a de novo administrative review, followed by judicial review before the U.S. Court of International Trade. It added that it is evaluating all available legal remedies with its U.S. trade counsel.

The company further stated that its U.S. business continues to operate normally and that there is no impact on its ongoing manufacturing, customer deliveries or commercial operations.

Background

The clarification follows media reports stating that CBP, in a final determination issued on June 23, 2026, found that Waaree had evaded tariffs on solar cells from Vietnam and Malaysia between 2021 and June 23, 2026. According to the reports, CBP also initiated action to assess anti-dumping tariffs of up to 271.28% on Waaree’s imported solar modules.

The investigation began in June 2025 following a petition filed by the American Alliance for Solar Manufacturing Trade Committee, whose members include First Solar and Hanwha Q CELLS USA.
