GERC proposes extension of green open access banking charges till August 2026

The Gujarat Electricity Regulatory Commission (GERC) has released a draft explanatory memorandum and draft fifth amendment regulations to the GERC (Terms and Conditions for Green Energy Open Access) Regulations, 2024, proposing extension of the existing banking charge of Rs 1.50 per unit until August 31, 2026, or until revised charges are notified separately.

The Principal Regulations, notified on February 21, 2024, had originally specified the banking charge of Rs 1.50 per unit only up to September 30, 2024. However, the Commission subsequently extended the charge through successive first, second, third and fourth amendment regulations up to May 31, 2025, September 30, 2025, March 31, 2026 and June 30, 2026, respectively.

According to the explanatory memorandum, GERC had commissioned a study to develop a long-term framework for banking charges. The Commission stated that the study involves collection and scientific analysis of substantial data and remains under progress, requiring additional time for completion.

Pending finalisation of the framework, GERC has proposed continuation of the existing banking charge as an interim measure.

Under the proposed amendments, Regulation 1(4) would specify that the banking charge under Regulation 17.6 shall remain effective from the date of notification of the Principal Regulations up to August 31, 2026, or until an earlier date if the Commission separately notifies revised charges.

Similarly, the proposed amendment to Regulation 17.6(viii) states that the banking charge of Rs 1.50 per unit shall continue until August 31, 2026, or until separate regulations prescribe revised charges, after which the newly notified charges would apply.
