The Uttar Pradesh Electricity Regulatory Commission (UPERC) has dismissed the petition filed by Prayan Ispat & Steel Pvt. Ltd., which sought relief under outdated provisions of the UP Electricity Supply Code 2005 for reviving its disconnected industrial unit.

The company, which has been disconnected since July 2023 due to unpaid dues of Rs 1.97 crore and internal disputes, requested benefits under Annexure 6.5 of the Supply Code. This provision was linked to the now-repealed Sick Industrial Companies Act, 1985.

In its ruling, UPERC highlighted the legal redundancy of Annexure 6.5, which became obsolete after 2016. The Commission emphasized that such relief should be addressed through legislative or regulatory procedures, not through adjudicatory proceedings. It also noted that the issue may be considered during future amendments to the Supply Code.

Furthermore, the Commission pointed out that the UP Industrial Policy 2012 now designates the UP Small Industrial Unit Rehabilitation Board as the authority responsible for addressing revival cases. As a result, the petitioner’s reliance on outdated clauses was deemed ineffective in the current regulatory framework.
